Regulamin świadczenia usług drogą elektroniczną w aplikacji GPFit · obowiązuje od 17 października 2026 r. · wersja 1.4
§1 Postanowienia ogólne i definicje
Konto – indywidualny profil Użytkownika chroniony adresem e-mail i hasłem.
§2 Usługi i wymagania techniczne
O dłuższych planowanych przerwach informuje z wyprzedzeniem, jeśli to możliwe.
§3 Konto
§4 Zasady korzystania
Użytkownik korzysta z aplikacji zgodnie z prawem, Regulaminem i dobrymi obyczajami.
wysyłanie spamu i niezamówionych informacji handlowych,
§7 Zdrowie i bezpieczeństwo
Użytkownik udziela Usługodawcy niewyłącznej, nieodpłatnej zgody na przechowywanie i wyświetlanie tych treści wyłącznie w zakresie potrzebnym do świadczenia usług (np. pokazanie planu Trenerowi).
§9 Reklamacje
Reklamacje dotyczące działania aplikacji można składać na adres e-mail: kontakt@gpfit.pl. Warto podać adres e-mail Konta, opis problemu i – jeśli to możliwe – zrzut ekranu.
§10 Rozwiązanie umowy i usunięcie konta
§12 Zmiany regulaminu i postanowienia końcowe
W sprawach nieuregulowanych stosuje się prawo polskie, w szczególności ustawę o świadczeniu usług drogą elektroniczną, Kodeks cywilny i ustawę o prawach konsumenta.
Spory z konsumentami rozstrzyga sąd właściwy według przepisów ogólnych.
Terms of electronic services in the GPFit app · effective from 17 October 2026 · version 1.4
This is an English translation provided for convenience. In case of any discrepancy, the Polish version prevails.
§1 General provisions and definitions
These Terms set out the rules for using the GPFit web application available at gpfit.pl (also as an app installed on the phone's home screen).
Service Provider – NESTARO spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office in Warsaw, ul. Nowogrodzka 50/54/515, 00-695 Warszawa, Poland, entered in the National Court Register (KRS) under no. 0001257679, NIP (tax ID) 7011325614, REGON 545398012, represented by Klaudia Chomicka, President of the Management Board, e-mail: kontakt@gpfit.pl.
User – a natural person who has created an Account. Client – a User connected with a Trainer. Trainer – a User who has turned on trainer mode. Gym – a club or sports facility using GPFit under a separate agreement with the Service Provider, together with its staff (administrator, reception).
Account – the User's individual profile protected by an e-mail address and password.
The Terms are made available free of charge before the agreement is concluded, in a way that allows them to be saved and printed.
§2 Services and technical requirements
The Service Provider provides, free of charge, an Account service under which the User can: record workouts and sets, build a training plan, keep a list of exercises and supplements, record body measurements and physique photos, view progress and records, generate PDF reports, chat with a Trainer and receive notifications.
Services for Gyms (gym panel, packages, member and trainer limits) are provided under a separate agreement with the Gym; these Terms apply to them accordingly.
To use the app you need: a device with Internet access, an up-to-date browser (e.g. Chrome, Safari, Firefox, Edge) with JavaScript and cookies enabled, and an active e-mail address.
The Service Provider makes every effort to keep the app running without interruption, but reserves the right to technical breaks (updates, maintenance, failures). Where possible, it announces longer planned breaks in advance.
§3 Account
The service agreement is concluded when the Account is created, the Terms are accepted and the Privacy Policy has been read. The agreement is concluded for an indefinite period.
An Account may be created by a person who is at least 16 years old. A minor uses the app with the knowledge of a parent or legal guardian.
When registering, the User provides their real first and last name and their own e-mail address – this allows the Trainer and the Gym to recognise the User.
One person may have one Account. The Account must not be shared with other people. The password must be protected; if it may have been disclosed, the Service Provider should be informed immediately.
Creating accounts automatically (scripts, bots) is prohibited. The Service Provider uses safeguards against such registrations.
§4 Rules of use
The User uses the app in accordance with the law, these Terms and good practice.
In particular, it is prohibited to:
provide unlawful, offensive or harassing content or content that infringes the rights of others (including in chat),
upload photos showing other people without their consent, or erotic content,
send spam and unsolicited commercial information,
attempt to access other people's data, bypass security measures, disrupt the app or overload the server (e.g. automated data scraping),
impersonate other people.
§5 Working with a trainer
The connection with a Trainer is created by the Client by entering the Trainer's e-mail in the Profile. A Client may have one Trainer and can disconnect them at any time.
Once connected, the Trainer sees the Client's plan, workout log and progress, can build the plan, enter set results, add exercises, measurements and supplements, and receive weekly reports. The Trainer sees photos and measurements only if the Client allows it.
The Trainer cannot delete the Client's data (workouts, measurements, photos, reports, messages). Plan changes are saved in the version history.
The Trainer is solely responsible for the content of their recommendations and for the lawfulness of their activity. The Service Provider only provides the tool and is not a party to the agreement between the Trainer and the Client.
The Trainer uses Clients' data only to run their training and keeps it confidential.
§6 Gym account
The User may join a Gym (e.g. by scanning a QR code at reception). The Gym may require membership verification by reception.
The Gym sees the membership status and basic information about the member's activity (e.g. dates and number of workouts, whether they have a trainer). It does not see the content of workouts, measurements, photos or messages.
The Gym may organise challenges (e.g. number of workouts in a month). Participation is voluntary – after joining, other participants see the User's first name, the first letter of their last name and their number of workouts; the User can leave a challenge at any time.
The Gym may run a strength ranking (e.g. bench press, squat, deadlift, pull-up). Participation is voluntary: the User submits their one-rep max together with body weight (and optionally height and biceps circumference), and the result appears on the list only after it is approved by a Gym trainer who witnessed the attempt. The place is based on DOTS points (result relative to body weight and sex). Only active people are shown on the list – with the minimum number of workouts recorded in the App in the last 30 days set by the Gym. The ranking lasts for the whole season; at the end of the last day of each month the App records the top three (award round). Any prizes are awarded and handed out by the Gym on its own terms. The Gym may show the ranking list on a screen in the gym (first name, last-name initial, result, points and tier – without body weight or other measurements). Max attempts are performed at one's own risk, with a spotter (§7).
The App includes Community – a forum (Profile → Community) with two boards: the Gym group, created by the Gym administrator and visible only to members of that Gym, and the “All GPFIT” board, visible to all signed-in Users of the App. Users can publish posts, questions and records in the board's sections, comment, react and suggest new sections (a new section appears after a moderator approves it). Each post shows the first name and the first letter of the last name. Before the first post the User accepts the board rules. In particular, the following are prohibited: swearing, insulting and harassing others, advertising and selling (including links, e-mail addresses and phone numbers), offering or promoting doping, drugs and other prohibited substances, and advice that endangers health. Advice from other members is their private opinion and does not replace consulting a trainer or a doctor (§7).
Community content is checked automatically: posts with swearing or links will not be published, and posts about, among other things, doping or risky weight loss wait for review by a moderator. Any User can report a post or comment; after 3 reports the content is hidden automatically until it is reviewed. Moderators of the Gym group are the Gym's trainers and administrators and the Service Provider, and of the “All GPFIT” board – the Service Provider. Moderators can hide content and temporarily or permanently block a User from posting on the board (reading remains available). The User can delete their own post or comment at any time and hide posts of a selected person for themselves.
If the Gym's package expires or is switched off, access may be suspended; the User's data is not deleted.
§7 Health and safety
GPFit is not a medical device and does not replace the advice of a doctor, physiotherapist or dietitian. Hints (e.g. weight increase, estimated max, records) are calculated automatically from the data entered and are for information only.
Before starting training, especially with illnesses, injuries, pregnancy or medication, consult a doctor.
The User exercises at their own risk, adjusts the load to their abilities, and stops the exercise in case of pain or feeling unwell.
Information about supplements is only for keeping one's own notes (stock, doses) and is not a recommendation to use them.
§8 User content
The User is responsible for the content they enter (entries, notes, photos, messages) and declares that they have the rights to it.
The User grants the Service Provider a non-exclusive, free-of-charge permission to store and display this content only to the extent needed to provide the services (e.g. showing the plan to the Trainer). The permission expires when the content or the Account is deleted.
The Service Provider may remove or block clearly unlawful content after receiving a credible report; reports can be sent to the Service Provider's e-mail address.
§9 Complaints
Complaints about how the app works can be sent to: kontakt@gpfit.pl. Please include the Account e-mail address, a description of the problem and – if possible – a screenshot.
The Service Provider handles a complaint within 14 days of receiving it and replies to the e-mail address it was sent from.
Consumers may use out-of-court dispute resolution, e.g. the help of a municipal or district consumer ombudsman or the provincial Trade Inspection office.
§10 Termination and account deletion
The User may terminate the agreement at any time, without giving a reason, by deleting the Account in the app: Profile → Account details → Delete account, or by writing to the Service Provider's e-mail address. Deleting the Account permanently deletes the User's data (details in the Privacy Policy).
The Service Provider may block or delete an Account that violates the Terms after an unsuccessful request to stop the violations, and in the case of gross violations (e.g. automatically created accounts, spam, hacking attempts) – without a request.
The Service Provider may stop providing the services entirely, informing Users at least 30 days in advance and allowing them to download their data beforehand.
§11 Liability
The Service Provider is liable for the proper provision of services under general rules. It is not liable for the effects of Trainers' recommendations, for the way the User performs exercises or for content entered by Users.
The Service Provider makes every effort to protect data against loss, but recommends that important data (e.g. PDF reports) also be stored by the User.
The provisions of these Terms do not exclude or limit the rights of consumers under mandatory provisions of law.
§12 Changes to the Terms and final provisions
The Service Provider may change the Terms for important reasons (e.g. changes in the law, new features, security). It informs about the change in the app at least 14 days before it takes effect. A User who does not accept the changes may delete their Account.
Matters not regulated here are governed by Polish law, in particular the Act on Providing Electronic Services, the Civil Code and the Consumer Rights Act. This does not deprive consumers of the protection granted by the mandatory laws of their country of residence.
Disputes with consumers are resolved by the court competent under general rules.
